Check My Age Terms of Use

The following terms and conditions govern all use of the Check My Age software and all content and features available through it (the ,,Service"). The Service is offered subject to your (the ,,Recipient") acceptance without modification of all of the terms and conditions contained herein and all other operating rules and policies that may be published from time to time (collectively, the ,,Agreement").

Please read this Agreement carefully before using the Service. By using the Service, you agree to become bound by the terms and conditions of this Agreement. If you do not agree to all the terms and conditions of this Agreement, then you may not use the Service. If these terms and conditions are considered an offer by Neurotechnology (the ,,Provider"), acceptance is expressly limited to these terms.

1. Services. The Service includes all features that are set forth in the ,,Check My Age" software, which the Provider may change from time to time, in its sole discretion.
2. Grant of Right to Use Services. The Provider will provide the Service to the Recipient pursuant to its standard policies and procedures then in effect. The right to use the Service is worldwide, temporal, revocable, non-exclusive, personal and non-transferable, subject to the terms and limitations as described in this Agreement.
3. Intellectual Property. All software, algorithms, design, and content of the service, with the exception of user-provided photos, are the property of UAB Neurotechnology. You are granted a limited, non-exclusive, non-transferable license to use the service for personal, non-commercial purposes only.
4. Recipient's Identity and Right to Do Business. The Recipient warrants:
   • that they are 18 years of age or older;
   • that they are legally authorized to consent to the processing of personal data, including photos and biometric data;
   • that you have the legal capacity to enter into this Agreement and to be bound by its terms.
   • that they have the right to use and upload photos that will not result in any legal claims from third parties;
   • if the Recipient is a legal entity, that it has the full right and authority to enter into, execute, and perform its obligations under this Agreement and that no pending or threatened claim or litigation known to it would have a material adverse impact on its ability to perform as required by this Agreement.
5. Use of Services. In order to use the "Check My Age" Service, you must comply with the following guidelines, terms, and conditions:
   • Your use of the Service must not violate any law, statute, ordinance, or regulation.
   • Your use of the Service must adhere to a Privacy Policy no less strict than the ,,Check My Age" Privacy Policy and comply with the General Data Protection Regulation (GDPR).
   • You are solely responsible for all data, information, and content you submit to the Service. You are prohibited from submitting any content that is illegal, defamatory, obscene, or harmful to third parties.
   • You clearly agree that your use of the Service does not imply any warranties regarding the accuracy of the results.
   • You must use the Service in a reasonable manner and comply with any limits specified in the Service's description.
   • You are responsible for the security and correct use of your device and the binding between your device and the "Check My Age" Service. In the event of any security threat, you must eliminate the threat as fast as possible, report it to the Provider, and actively cooperate with us on it.
6. Prohibited Uses. The Service must not be used, directly or indirectly, in connection with or to promote any products, services, or materials that are unlawful, promote hate, violence, terrorism, racial intolerance, pornography, infringe on intellectual property rights, or are otherwise unacceptable under the laws of the Republic of Lithuania.
7. Prohibited Reuse of the Service. The Application and Services are for personal, non-commercial use only. You are prohibited from using the Service or any part of it for any commercial purpose, including, but not limited to, selling, licensing, assigning, copying, or integrating it into any other product or service without the Provider's explicit written consent. Your usage rights are non-transferable and are valid for your personal needs only. Specifically, you are prohibited from using the Service, the results (Outputs), any underlying algorithms, or any data derived therefrom to train, fine-tune, develop, or improve any competing artificial intelligence model, software, or service that performs age estimation, face detection, or similar biometric analysis.
8. User Feedback and Service Improvement. To help us improve the accuracy of our Service, you may choose to provide feedback on the age result. This feedback may include indicating whether the result was "correct" or "incorrect," and in the case of an "incorrect" result, providing your actual age. All such feedback is provided voluntarily and will be used in a non-person-identifiable manner to improve our algorithms.
9. Submission of materials to the Services. When you submit any materials to the Service, You are entirely responsible for the content of, and any harm resulting from, that Content. That is the case regardless of whether the Content in question constitutes text, graphics, images, photos, audio or video file, source code, computer software or other type of materials. By making Content available, you represent and warrant including but not limited that:
   • Use of the Content will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights, of any third party.
   • If your employer has rights to intellectual property you create, you have either (i) received permission from your employer to post or make available the Content, including but not limited to any software, or (ii) secured from your employer a waiver as to all rights in or to the Content.
   • You have fully complied with any third-party licenses relating to the Content, and have done all things necessary to successfully pass through to end users any required terms.
   • The Content does not contain or install any viruses, worms, malware, Trojan horses or other harmful or destructive content.
   • The Content is not pornographic, does not contain threats or incite violence towards individuals or entities, and does not violate the privacy or publicity rights of any third party.
   • You have, in the case of Content that includes computer code, accurately categorized and/or described the type, nature, uses and effects of the materials, whether requested to do so by the Provider or otherwise.
   • For Content provided to the Service, you grant the Provider a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content.
   • For Content submitted for processing to the Service, you grant the right to use the Content in a non-person-identifiable manner to improve quality and user experience of our Services.
   • Without limiting any of those representations or warranties, the Provider has the right (though not the obligation) to, in the Provider's sole discretion (i) refuse or remove any content that, in Provider's reasonable opinion, violates the Provider policy or is in any way harmful or objectionable, or (ii) terminate or deny access to and use of the Service to any individual or entity for any reason.
10. Responsibilities of the Application users. The Provider has not reviewed, and cannot review, all of the material, including images, audio, video, text, source code or computer software, provided to the application or transferred through Services, and cannot therefore be responsible for that material's content, use or effects. By providing the Services, the Provider does not represent or imply that it endorses the material there provided, or that it believes such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Services may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical inaccuracies, typographical mistakes, and other errors. The Services may also contain material or products and services may be operated in a way that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. The Provider disclaims any responsibility for any harm resulting from the use by users of the Services, or from any use of the Services by those users and materials they provided.
11. Content of Other websites. The Service may contain links to websites that are not owned or controlled by the Provider. The Provider has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites. You further acknowledge and agree that the Provider shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites.
12. Third-Party Services. The Service may be integrated with or make use of third-party services, applications, or websites (collectively, ,,Third-Party Services"). These Third-Party Services are not under the control of the Provider, and the Provider is not responsible for their content, functionality, or privacy practices. Your use of any Third-Party Services is at your own risk and is subject to the terms and conditions of those Third-Party Services. The Provider is not liable for any damage or loss caused by your use of such Third-Party Services.
13. Support. The Provider may provide technical support for its Services in some situations. However, the Provider may decide, in its sole discretion, to provide technical support, general support or customization for its Services (collectively "Support"), and may terminate that Support at any time with or without notice. The Provider may change, suspend or discontinue any or all features of Services at any time. Also, the Provider may limit or restrict completely access to the Application or Services without any notices or liabilities.
14. Fees. The Service is provided free of charge, and the Recipient agrees not to pay any fees for the use of the Service.
15. Termination. The Provider may terminate your use of all or any part of the Service at any time, with or without cause, with or without notice, effective immediately. If you wish to terminate this Agreement you may simply immediately discontinue using the Service. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnification and limitations of liability.
16. No High Risk Use. The Services are not fault-tolerant. The Application is not designed or intended for use in any situation where failure or fault of any kind of the Service could lead to death or serious bodily injury of any person, or to severe physical or environmental damage ("High Risk Use"). You are not allowed to use the Application or Services in, or in conjunction with, High Risk Use. You agree that any such use will be solely at your own risk, and you shall full indemnify Provider for any losses arising from such unauthorized High risk use. High Risk Use is STRICTLY PROHIBITED. High Risk Use includes, for example, the following: aircraft or other modes of human mass transportation, nuclear or chemical facilities, and Class III medical devices under the Federal Food, Drug, and Cosmetic Act. You agree not to use the Application or Services in, or in connection with, any High Risk use.
17. Disclaimer. THE Service IS PROVIDED "AS IS" AND AS AVAILABLE, AND PROVIDER MAKES NO WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS. Without limiting the generality of the foregoing, (i) PROVIDER HAS NO OBLIGATION TO INDEMNIFY OR DEFEND RECIPIENT AGAINST CLAIMS RELATED TO INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS; and (ii) Provider does not warrant that the Application or Services will perform without error or interruption. You understand that you use the Application and Services at your own discretion and risk, and you are solely responsible of any damage to your device or data that results from such use.
18. Limitation of Liability. IN NO EVENT WILL PROVIDER BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, SPECIAL, INCIDENTAL, OR PUNITIVE DAMAGES ARAISING FROM OR CENNECTED WITH USE OF THE PROVIDER SERVICES. THE LIABILITIES LIMITED BY THIS SECTION APPLY: (i) TO LIABILITY FOR NEGLIGENCE; (ii) REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, STRICT PRODUCT LIABILITY, OR OTHERWISE; (iii) EVEN IF PROVIDER IS ADVISED IN ADVANCE OF THE POSSIBILITY OF THE DAMAGES IN QUESTION AND EVEN IF SUCH DAMAGES WERE FORESEEABLE; AND (iv) EVEN IF RECIPIENT'S REMEDIES FAIL OF THEIR ESSENTIAL PURPOSE. If applicable law limits the application of some provisions of this Section, some provisions of this Section may not apply to you. The Provider's total liability in any matter arising out of or related to this Agreement is limited to zero (0) euros, as the Service is provided free of charge.
19. Indemnification. You agree to indemnify the Provider for any losses, costs, or damages, including legal fees, incurred because of your violation of this Agreement.
20. Independent Contractors. The parties are independent contractors. This Agreement does not create a partnership, franchise, joint venture, agency, fiduciary, or employment relationship between the parties. Neither party has the authority to bind the other, and neither may make commitments on the other's behalf.
21. Force Majeure. To the extent caused by force majeure the Provider will not be liable for delays or any failure to operate the Application, provide Services or perform this Agreement.
22. Final Provisions.
    • Entire Agreement. This Agreement constitutes the entire agreement between you and the Provider with respect to the subject matter hereof and supersedes all prior agreements, understandings, and negotiations.
    • No Waiver. The Provider's failure to enforce any provision of this Agreement shall not be construed as a waiver of the right to enforce such provision at a later time.
    • Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the Republic of Lithuania.
    • Dispute Resolution. All disputes arising from this Agreement shall be settled through negotiation. If an agreement cannot be reached, the disputes shall be settled in the courts of the Republic of Lithuania.
    • Severability. If any provision of this Agreement is held to be invalid, this will not affect the validity of the remaining provisions.
    • Modifications. The Provider reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of the Service following the posting of any changes to this Agreement constitutes acceptance of those changes.
    • Compliance with Legislation. By using Service, you agree to comply with all applicable European Union laws and regulation, including any laws and regulations related to Artificial Intelligence that my come into force during your use of the Services.
